Nicole “Niki” Martell is a Senior Associate Attorney at David Di Pietro & Associates where she focuses on practicing health care law, probate litigation, and general business and commercial litigation. Niki is an experienced and aggressive trial attorney, working closely with the head of the firm, David Di Pietro.
Since joining David Di Pietro & Associates, Niki has represented and defended Physicians in medical malpractice actions in both federal and state court, from the commencement of pre-suit through trial. This includes handling corresponding administrative licensing matters with the Florida Board of Medicine. Physicians have benefitted from Niki’s business and employment law experience, as she provides a well-rounded variety of legal services such as assisting with contractual, licensing, wage and business matters arising from medical practice ownership and management. Additionally, Niki has advocated in court on behalf of families in both probate and guardianship matters on numerous occasions, including obtaining temporary and permanent injunctions to preserve the assets and well being of elderly or incapacitated individuals.
Niki has also represented both businesses and individuals in a variety of matters, including contractual disputes, temporary and permanent injunctions, dissolution of partnerships and corporations, fraud, construction law and wage and discrimination claims.
Niki started her career as an Assistant State Attorney at the Broward State Attorney’s Office, where she quickly advanced to take on more complex and impactful cases, ranging from trafficking of illegal narcotics to violent victim crimes. In the role of Assistant State Attorney, she gained extensive litigation experience, having tried over 50 jury and bench trials. Additionally, she has drafted, researched and litigated numerous pretrial motions involving a variety of legal issues in a broad range of criminal matters. Most recently, she took the lead in researching and composing written responses on behalf of the State Attorney’s Office to address two key legal issues with the courts: the impact of the Florida Supreme Court’s revision of the discovery rules on the prosecution’s obligation to disclose confidential informants and a proposed process for handling the legislature’s implementation of the Violent Offender of Special Concern classification.
Niki is a lifelong resident of South Florida, where she graduated from St. Thomas Aquinas High School. She obtained a Bachelor of Arts in Public Relations with a minor in Business Management from the University of Florida in 2009 and her Juris Doctor degree from Florida State University in 2012. Niki is admitted into practice throughout Florida, as well as in all three U.S. District Courts in Florida.
Niki handles a variety of litigation matters for the firm, including Medical Malpractice Defense, Business Litigation, Employment Law matters, Probate and Trust Litigation, Guardianship, Products Liability for Medical Devices and Government and White Collar cases.
