Publicly Documented Litigation

Fort Lauderdale-Hollywood International Airport Shooting Wrongful Death Lawsuit

Following the January 2017 mass shooting at Fort Lauderdale-Hollywood International Airport, David Di Pietro and attorneys with Di Pietro Partners represented Timothy Woltering, as personal representative of the estate of his mother, Olga Woltering, who was killed in the attack.

The wrongful death lawsuit alleged that Delta Air Lines, Allied Universal, and other defendants failed to take appropriate security measures that could have prevented the shooting. Among other allegations, the complaint addressed procedures involving passengers retrieving firearms from checked luggage and security conditions at the airport.

Whistleblower Litigation Experience

21st Century Oncology False Claims Act Litigation

David Di Pietro also has firsthand experience with False Claims Act litigation as a whistleblower relator.

In 2016, Di Pietro filed a qui tam action against 21st Century Oncology related to the company’s 25-year radiation oncology contract with Broward Health. The complaint alleged violations of federal law connected to the contract and government healthcare billing.

The federal government declined to intervene, and 21st Century Oncology disputed the allegations. Subsequent bankruptcy proceedings resulted in dismissal of the related adversary proceeding, and Di Pietro later voluntarily dismissed the underlying whistleblower complaint.
