Peptide popularity continues rising in the United States. Increased demand outpaces regulation. This fact alone presents problems. For example, folks hear about the great benefits of a particular peptide and they want it regardless of the method employed to obtain the product.

Certain peptides may accelerate weight loss, promote muscle repair, provide anti-aging skin care, and numerous medical treatments. Since FDA approval may take a decade or more, people find ways to obtain these “miraculous” pills or injections from available sources. As a result, wellness clinics or online sources may supply peptides awaiting FDA approval.

Penalties for using, prescribing, manufacturing, compounding, or distributing illegal peptides may be severe under both Florida and federal law. The Florida Drug and Cosmetic Act, Chapter 499 lists the consequences for breaking these laws. Penalties may include up to 15 years in prison, or a $10,000 fine (second degree felony). This applies to pharmacies, sellers, and clinics.

If the charge is raised to a first-degree offense, the penalties increase. Federal charges may also be applied. Criminal charges in federal court carry stiff sentences and a possible 20+ years in prison. Additionally, clinics or pharmacies may be ordered to shut down.

Numerous other lawsuits aimed at providers or prescribers may also carry stiff penalties. Simple possession of an unapproved peptide by an individual for personal use is rarely prosecuted.
