Novation Hip Recall Lawyers

The goal of hip replacement surgery is to improve a patient’s quality of life through restoring the normal function of their joint and repairing the issues causing joint pain, arthritis and loss of mobility. Even though the majority of these operations are successful, there are some unfortunate situations where things go wrong with the joint implants. Has become an issue with the Novation® hip implants in particular, which have recently been recalled by the manufacturer Exactech. Patients who have received these implants may be entitled to just compensation.

Novation Hip Implant Complications

While the majority of Novation® hip replacements installed over the years have been without issues, unfortunately there have been situations where these Exactech manufactured implants have resulted in serious complications for recipients. These complications have been traced back to defective packaging that allowed implants to be exposed to the atmosphere, which caused premature degradation of the insert material and subsequent joint looseness and failure.

Ultimately, the only way to fully rectify this situation is surgery to replace the defective and failed parts. Generally speaking, the following symptoms are experienced by those who are having complications with Novation® hip inserts:

  • Joint instability
  • Swelling in or around the Joint
  • Minor or major joint function impairment
  • Consistent Joint Pain
  • Joint Stiffness

Because these packaging issues were widespread throughout most of Exactech’s implant lineup, there are multiple types of implants manufactured by Exactech that are now being recalled by the FDA. Included in this are Novation® implants, which are part of a Class 2 Device Recall by the Food and Drug Administration (FDA). The cause behind these implants being recalled is material deterioration due to improper factory packaging. If you or someone you know is suffering from complications that are a result of a defective Novation® insert or any other type of Exactech® replacement joint or medical device, you could be eligible to file a lawsuit to receive just compensation.

Defined by the Food and Drug Administration specifically as “a situation in which use of or exposure to a violative product may cause temporary or medically reversible adverse health consequences”, a Class 2 Device Recall allows for victims to seek just compensation through legal action. Accordingly, this lawsuit may qualify as a mass tort or class action lawsuit.

For an individual to be considered eligible for an Exactech® knee replacement lawsuit in the United States, there are several requirements that must be met:

  • Received a Novation® hip implant within the United States
  • Suffered ill effects or complications from a Novation® implant that prematurely malfunctioned or failed due to defects
