Case Details

A new Colorado law banning untraceable guns made using kits or 3D printers took effect on New Year’s Day. Two gun rights groups filed a lawsuit against the state, arguing the law contradicts the Supreme Court’s recent ‘historical standard’ ruling. The law targets ‘ghost guns’, requiring all guns to have serial numbers, and limits gun manufacturing to licensed manufacturers.

The lawsuit cites historical American gunsmithing practices and challenges the restriction, asserting it infringes on Second Amendment rights. This legal action is part of ongoing challenges to Colorado’s strict gun laws.

According to Attorney David Di Pietro,
When you own a firearm and bring it to a gun store or buy a gun from a store, that transaction is registered. The ATF or state agencies can figure out who purchased that gun last. When you look at the constitution when it was made and ratified in 1787, the historical tradition was people made their own guns back in the 1700’s. At face value, this law will likely be ruled as unconstitutional and struck down at the federal level.

Arizona defense lawyer Dwane Cates also commented, Colorado’s defense is that this doesn’t infringe on the lawful ability to obtain firearms. If you follow proper procedure, you’re still allowed to carry firearms and exercise your Second Amendment Rights.
